They include transcripts, electronic records, stenographic tapes or videotapes of court proceedings, depositions, or other proceedings filed with the Brevard County Clerk, and documentary exhibits in the Clerk's custody.

Are Court Records Public in Brevard County?
According to the Florida Freedom of Information Act (FOIA), court records are public in Brevard County. Therefore, all documents filed with the Brevard County Clerk are available for public inspection during regular business hours, except for court records specifically exempt by judicial order or Florida statute. How to Conduct a Brevard County Case Records Search
Individuals can find Brevard County case records at the Clerk of Circuit Court's office. Requests can be online through the Research & Copy Request Center or the BECA - Brevard Electronic Court Application portal. Requests for certified copies of court records can be placed via the Research & Copy Request Center, but uncertified copies are available through the Case Search portal. Both only platforms require registration, but BECA offers a general public case search option without registration. The Research & Copy Request Center charges the following fees for court records:

Brevard County Civil Court Case Records
A Brevard County civil court record is a legal document that outlines a person's disputes, claims, and judgments in a civil court case. The Brevard County Courts department encompasses the following divisions within the Clerk's Office:
- Circuit Civil: The Brevard County Circuit Court has jurisdiction over civil cases in which the amount in controversy exceeds $50,000. They also handle actions involving the title and boundaries of real property, injunctions, all cases in equity, and all civil matters not within the County Court's jurisdiction.
- County Civil: The Brevard County Court has jurisdiction over civil cases in which the controversy is between $8,000 and $50,000.
A civil court case document can be ordered online, by mail, phone, email, or in person at any of the Brevard County Clerk's branch offices. Online requests can be made through the Case Search portal. The search criteria are by person name, business name, case number, or case type. In-person requests must be between Monday and Friday, from 8:00 am to 5:00 pm (excluding Holidays). Note that the Merritt Island and Palm Bay branch offices are usually closed between 11:30 am and 1:30 pm, but all other court branches will be open during these times.
Brevard County Criminal Court Case Records
A criminal court record is any record maintained by the Brevard County Clerk that contains information on a traffic or criminal proceeding. The Clerk oversees the Felony and Misdemeanor Divisions in Brevard County. The Circuit Court has jurisdiction over all felony cases. A felony is a criminal offense punishable by imprisonment in a state penitentiary or death. The Circuit Coult also handles juvenile criminal cases like misdemeanors, felonies, contempt of court, or local ordinance violations.
In contrast, the County Court has jurisdiction over all misdemeanors. A misdemeanor is a criminal offense punishable by imprisonment in a Brevard County correctional facility. The County Court also handles criminal traffic cases.
